Terms of Service

These Terms of Service ("Terms") govern your use of the DepartBuddy iPhone and iPad application and its related email-import service (together, the "Service"). The Service is provided by Miguel Carranza ("DepartBuddy," "we," "us," or "our").
By downloading or using DepartBuddy, you agree to these Terms. If you do not agree, do not use the Service.

1. Apple Terms
If you obtain DepartBuddy through Apple's App Store, Apple's applicable media-services terms and the Standard Apple Licensed Application End User License Agreement also apply. These Terms supplement Apple's terms and do not limit rights that Apple or applicable law grants you.
2. Eligibility and Accounts
You must be at least 13 years old, or the minimum age required to consent to the Service in your country. DepartBuddy does not currently require a DepartBuddy account. Anonymous identifiers may be created to provide email import, iCloud continuity, and subscription access. You are responsible for securing your device, Apple Account, private forwarding address, and booking information.
3. The Service and Travel Information
DepartBuddy helps you organize travel information that you enter or choose to forward. It may parse booking emails, display trips and reservations, store tickets and pass codes, show checklists and notes, identify details that may need attention, publish optional read-only trip links, and link to third-party maps, booking pages, or flight-tracking websites.
Trip links are capability links: anyone who receives one can view the information you selected until you revoke it or it expires. Upcoming or active trip links expire seven days after the trip ends; completed-trip links expire seven days after creation. You are responsible for choosing the sharing profile, reviewing its preview, and sending the link only to people you trust. A recipient may import a detached copy into DepartBuddy. That copy is not synchronized with your trip, and revoking your link does not remove a copy the recipient already imported.
DepartBuddy is not a travel agency, airline, hotel, transportation provider, booking agent, or emergency service. We do not sell travel, control provider operations, or guarantee that imported or displayed information is complete, current, or correct. Parsing can make mistakes, and travel providers can change schedules, gates, policies, prices, or reservations without notifying us.
You must review imported information before saving it and verify important details directly with the relevant provider. Do not rely on DepartBuddy as the sole source for departure times, check-in, entry requirements, safety information, cancellations, or emergencies.
4. Free Service and DepartBuddy PRO
Manual trip planning and manual reservations are available without a subscription. The free plan includes a limited number of accepted email imports. DepartBuddy PRO is an optional auto-renewable subscription that unlocks unlimited email imports and Calendar Sync during an active subscription.
- Plans: monthly and annual plans are offered. Current prices and billing periods are shown in the app and App Store before purchase.
- No trial: DepartBuddy does not currently offer a free trial.
- Billing: payment is charged to your Apple Account when you confirm the purchase.
- Renewal: the subscription renews automatically unless canceled at least 24 hours before the end of the current billing period. Your Apple Account is charged for renewal within 24 hours before that period ends.
- Cancellation: manage or cancel in Settings > Apple Account > Subscriptions. Deleting DepartBuddy does not cancel the subscription. Cancellation takes effect at the end of the paid period unless Apple states otherwise.
- Restores: eligible purchases can be restored through the paywall's Restore Purchases action.
- Refunds: Apple processes billing and refund requests under its policies. We cannot issue App Store refunds directly.
- Changes: Apple may handle price-change consent or notice. We may change future pricing or PRO features as permitted by law, without removing access already owed for a paid period.
5. Your Content
"Your Content" includes trips, names, reservations, confirmation emails, booking codes, ticket or pass-code data, photos, notes, checklists, and other material you enter, select, scan, or forward. You retain your rights in Your Content.
You give us a limited license to host, process, transmit, and display Your Content only as needed to provide, secure, and support the Service. This license ends when the content is deleted, except for temporary backups, minimal allowance records, legal retention, or third-party retention described in the Privacy Policy.
You are responsible for Your Content and for having permission to process information belonging to other travelers. Do not submit unlawful, harmful, infringing, fraudulent, or unauthorized content. Treat forwarding addresses, confirmation codes, pass codes, and trip share links as private.
6. Acceptable Use
You may use DepartBuddy for personal, non-commercial trip organization. You may not:
- misuse the forwarding service to send spam, malware, bulk mail, or non-travel content;
- attempt to access another user's trips, imports, identifiers, or subscription;
- bypass import limits, payment controls, security measures, or service restrictions;
- disrupt, overload, scrape, or probe the Service or its infrastructure;
- reverse engineer the Service except where applicable law expressly permits it; or
- use the Service in violation of law or another person's rights.
We may limit or suspend access to server features when reasonably necessary to protect the Service, other users, or third parties.
7. License and Ownership
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use DepartBuddy on Apple devices you own or control, subject to these Terms and Apple's usage rules. DepartBuddy's software, design, and original content are owned by Miguel Carranza or licensors and are protected by intellectual-property laws. Travel-provider names and marks belong to their respective owners and are used only to identify relevant services.
8. Privacy
The DepartBuddy Privacy Policy explains how the Service handles information, including forwarded emails, iCloud storage, subscriptions, retention, and deletion. By using a feature that processes information, you instruct us to process that information as described in the Privacy Policy.
9. Third-Party Services
DepartBuddy relies on or links to services provided by Apple, Cloudflare, Google (including an optional Gemini fallback for low-confidence email parsing), RevenueCat, Wikimedia, maps providers, travel providers, and flight-information websites. Their own terms and privacy policies apply. We do not control and are not responsible for third-party content, availability, accuracy, transactions, or acts. A link does not imply endorsement or affiliation.
10. Availability and Changes
We work to keep DepartBuddy available, but the Service may be interrupted, delayed, or unavailable. Email delivery, parsing, iCloud sync, subscription verification, and external links depend on third-party systems. We may modify or discontinue features, maintain the Service, or introduce reasonable limits. When practical and legally required, we will provide notice of material changes.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR SUITABLE AS YOUR ONLY SOURCE OF TRAVEL INFORMATION.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGUEL CARRANZA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, TRAVEL, RESERVATIONS, OR OPPORTUNITIES, ARISING FROM THE SERVICE OR THIRD-PARTY TRAVEL CHANGES.
OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR DEPARTBUDDY DURING THE 12 MONTHS BEFORE THE CLAIM OR USD $50. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE CONSUMER LAW.
13. Termination
You may stop using DepartBuddy at any time. You can delete trip data using the app and request deletion as described in the Privacy Policy. Stopping use or deleting the app does not cancel an active subscription.
We may suspend server access for a material violation of these Terms, abuse, fraud, security risk, or legal requirement. Provisions that by their nature should survive termination, including ownership, disclaimers, limitations, and accrued payment obligations, will survive.
14. Changes to These Terms
We may update these Terms as the Service changes. We will publish the revised Terms and update the effective date. If required, we will provide additional notice. Continued use after revised Terms take effect means you accept them, except where applicable law requires another form of consent.
15. General
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business reorganization or transfer of the Service, subject to applicable law.
Applicable mandatory consumer protections and your right to bring a claim in a court available under local law are not limited by these Terms.
